  • Social Media DM Messaging via STIMULATE accounts 
  • STIMULATE Mobile Apps
  • STIMULATE webinars and other digital hosted experiences including but not limited to STIMULATE+Workshop 
  • Attendance in person at STIMULATE events that include STIMULATE’s annual trade show + conference in Nashville, TN, held annually as well as STIMULATE+Converstions LIVE events held in various cities each year

Throughout this privacy policy we’ll refer to our events, webinars, workshops, social media engagement + digital connectivity collectively as “Services.” 

Any person browsing, participating, accessing or otherwise using the Services or any of the mediums listed above – either manually, physically or via an automated device or program – to the extent permitted hereunder, shall be considered a “User” under this privacy policy. All Users are bound by the terms of this privacy policy. 

Why we collect certain information from you:

  • To provide the Services provided by STIMULATE, this collection helps better understand our audience, our Users, our target attendees of our experiences and exhibitor / vendor support of our experiences. 
  • For identification and authentication purposes
  • Business management interests that include invoicing, event and experience performances and overall security.
  • To improve the functionality and performance of our website.
  • To improve the functionality and performance of our events.
  • To enable us to contact you if needed.
  • Other purposes that you consent to.

What information do we collect?

STIMULATE, Inc., is a community without membership needed that supports the sexual wellness community at large. This includes . Personal information is requested to participate in many of our experiences that includes but is not limited to name, email, physical address, job title, company associated with and more. Additionally, the below information may be collected: 

  • Personal Information you provide to us. As a user of STIMULATE’s website, you have the choice to opt into experiences that ask you to provide information to us about yourself that may include your name, address, place of employment, job title, photograph, phone number, email address, date of birth if applicable and more. You may provide this information when you register at your consent. In addition, when you register on our Website or send a message on the Website or to our DM via social media at your choice, your personal identifiable information, including your email, will be added to our customer database and distribution list.
  • Technical Information gathered automatically. STIMULATE collects information on how you interact with our websites, such as the IP address from which you access the services, information about your browser, operating system and computer or device, date and time of use, pages viewed, and actions or items clicked. We may also collect location information, including location information automatically provided by your computer or device. We use cookies and similar technologies to collect some of this information. The STIMULATE official website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”) which uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site.
  • Personal Information Provided to Us by Others. In certain instances, third parties may share your personal information with us in an effort for STIMULATE to identify companies or individuals who may benefit from STIMULATE opportunities or services.  In its possession, your information will be subject to STIMULATE’s Privacy Policy.  
  • Financial Information: STIMULATE may collect credit, debit card, Zelle, Apple Pay, Pay Pal or other digital transaction information to facilitate a transaction. If you purchase a pass to a STIMULATE experience or are an exhibitor or sponsor, you will need to provide additional personal and payment information that is required to process the transaction and your payment if you are paying by credit card. This information includes, name on credit card, billing address of cardholder, credit card number, expiration date, and authorization code on card.
  • Payment Information: When you make a purchase for our services, any credit card information you provide on a hard copy registration form is held in a secure location after its entry into our membership or meeting registration systems.  Our payment database does not keep a record of the full card number, but instead keeps the data as a confirmation of payment.  The payment processor we use for credit card payments is Intuit and Stripe with payment support also provided by Connect Space. 
  • STIMULATE obtains contact details and other personal information regarding media contacts and influencers from a variety of sources including Cision. How We Use the Information We Collect

We use your information in the following ways:

  • To process your inquiries and deliver customer service;
  • To provide, maintain and improve our services including to operate certain features and functionality of our websites (for example, by remembering your information so that you will not have to re-enter it during this or subsequent visits);
  • To process your inquiries and otherwise deliver customer service to better support you;
  • To provide the attendee, exhibitor or sponsor services you have requested;
  • To process your payments;
  • For identification and authentication purposes;
  • For our legitimate interests like invoicing purposes, network performance and security;
  • To control unauthorized use or abuse of our Services, or otherwise detect, investigate or prevent activities that may violate our policies or be illegal;
  • To analyze trends, administer or optimize the services, monitor usage or traffic patterns (including to track users’ movements around our websites);
  • To communicate directly with you, including by sending you newsletters, promotions and special offers or information about experiences and services from STIMULATE and / or approved partners of ours;
  • For other purposes as disclosed at the time of collection.

Where we intend to use or otherwise process your personal information for purposes other than the purpose for which it was collected, we will provide you with information regarding the purpose for the processing, as well as other relevant information, prior to processing your personal information. Please note, we do not use automatic decision‐making or engage in profiling.

How We Share the Information We Collect

  • With our Affiliates;
  • With our exhibitors and sponsors of STIMULATE experiences – both virtual and in person experiences;
  • With Zoom as needed to participate in select experiences provided by STIMULATE that you register for or opt into via Zoom by participating on a call (Zoom) with STIMULATE 
  • With Quickbooks as part of payment processing and account management 
  • With HubSpot as part of account management and attendee engagement, including email marketing purposes 
  • Pursuant to a court order, subpoena, warrant, or when otherwise required by law, or in response to a government inquiry;
  • To protect our rights and the rights or safety of third parties, including to protect the security and integrity of the Services; and;
  • As part of a potential or actual sale, merger or acquisition, or other transfer of all or part of our assets, including as part of a possible bankruptcy

STIMULATE may share information that has been anonymized or aggregated without limitation.

General Data Protection Regulation (GDPR) and International Visitors

This section applies to those that visit our Services from the European Economic Area and Switzerland.

Lawful Basis for Processing:

STIMULATE processes personal information with your consent (e.g., when you agree that STIMULATE  may place cookies, or when STIMULATE processes personal information submitted to the Services for specified purposes).

On other occasions, STIMULATE may process personal information when it needs to do this to fulfill a contract (for example, for account management and billing purposes) or where required to do this by law.

If necessary, STIMULATE may also process personal information when it is in STIMULATE’s legitimate interests to do this (e.g., to provide event attendee support or fraud detection) and when these interests are not overridden by your data protection rights.

If the processing of personal information is necessary and there is no statutory basis for such processing, we will ask you for consent to process your personal data. You have the right to withdraw your consent to processing of personal information at any time.

Please be aware that the personal information we collect may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location. If you are located outside of the United States, please be advised that we process and store personal information in the United States and your consent to this privacy notice represents your agreement to this processing.

Your Rights:

  • The right to be informed; This means anyone processing your personal data must make clear what they are processing, why, and who else the data may be passed to.
  • The right of access; this is your right to see what data is held about you by a Data Controller.
  • The right to rectification; the right to have your data corrected or amended if what is held is incorrect in some way.
  • The right to erasure; under certain circumstances you can ask for your personal data to be deleted. This is also called ‘the Right to be Forgotten’. This would apply if the personal data is no longer required for the purposes it was collected for, or your consent for the processing of that data has been withdrawn, or the personal data has been unlawfully processed.

Retention

We will process and store your personal information only for the period necessary to achieve the purpose of the storage, or as permitted by law. The criteria used to determine the period of storage of personal information is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract or the initiation of a contract or for other lawful purposes.

Information used for certain purposes when we ask for this information. If you decide to opt‐out, we may not be able to provide the Services to you. If you do not want to be included in user lists, you may opt‐out by submitting a request to STIMULATE via stimulate@retailminded.com.
